E-Commerce rules

These Electronic Commerce Rules (hereinafter referred to as the “Rules”) are a legally binding document which sets out the rights, obligations and responsibilities between the Buyer (hereinafter referred to as the “BUYER”) and Glaja MB (hereinafter referred to as the “SELLER”) in relation to the purchase of goods by the BUYER in an electronic https://glajakids.lt/ shop (hereinafter referred to as “e-shop”).

The contract between the BUYER and the SELLER shall be concluded in accordance with the Civil Code of the Republic of Lithuania and the Retail Trade Rules approved by the Government of the Republic of Lithuania in 2014. 22 July Resolution 738.

  1. GENERAL PROVISIONS
  1. The following are entitled to use the e-shop services:
    1.1. able-bodied natural persons aged at least 18 years;
    1.2. minors aged between 15 and 18 years only with the consent of their parents, adoptive parents or guardians, except in the case of self-disposal of their earnings or scholarship;
    1.3. legal persons;
    1.4. authorised representatives of all the above.
  2. By accepting the rules of “www.glajakids.lt”, the Buyer confirms that he/she is entitled to purchase goods in the e-shop of “www.glajakids.lt”.
  3. There are two ways for the Buyer to order goods in the e-shop:
    3.1. by registering in the e-shop with your username and password;
    3.2. without registering on the website.
  4. The personal data provided by the BUYER (name, surname, address, telephone number, e-mail address) when registering in the e-shop shall be stored and processed in accordance with Art. 21 January Law No. IX-1296 and the “Privacy Policy” described in Appendix 1 to these Rules.
  5. The prices of the goods listed in the e-shop catalogue are valid only when you purchase these goods in the e-shop. The prices of the products in the e-shop are inclusive of VAT. Shipping costs are not included and are quoted separately when ordering.
  6. The contract of sale between the BUYER and the SELLER shall be deemed to have been concluded from the moment when the BUYER clicks on the “ORDER” button in the e-shop, after having created the shopping cart, indicated the delivery address, and chosen the payment method.
    6.1. The e-shop informs the BUYER about the conclusion of the contract of sale, i.e. the confirmation of the order of the goods, by sending a message to the e-mail address indicated by the BUYER. to the following postal address.
  7. The contract concluded electronically between the e-shop “glajakids.lt” and the BUYER is stored in the e-shop and can be accessed by the BUYER in electronic form.
  1. RIGHTS AND OBLIGATIONS OF THE BUYER
  1. The PURCHASER is entitled to make purchases in the e-shop in accordance with these rules.
  2. The BUYER has the right to withdraw from the contract for the purchase and sale of goods concluded with the e-shop “glajakids.lt” by notifying the Seller in writing (by e-mail info@glajakids.lt indicating the product to be returned and its order number) no later than 14 (fourteen) days from the date of delivery.
  3. The BUYER is responsible for all his/her actions when using the e-shop.
  4. The BUYER must provide complete and correct details in the e-shop registration form. If the PURCHASER’s personal data have changed and the e-shop has not been informed, the PURCHASER shall bear all risk of loss arising therefrom.
  5. The BUYER must be present at the specified location to receive the goods ordered. To pay for the goods with the required amount of money.
  6. The BUYER undertakes not to disclose his/her registration and login data to third parties. If the BUYER loses his/her login details, he/she must immediately inform the following e-mail address info@glajakids.lt .
  7. If the BUYER, at the time of delivery of the goods, refuses to accept the goods without valid reasons, the BUYER shall be obliged to bear the costs of returning the goods upon the SELLER’s request.
  8. By using the e-shop, the BUYER agrees to these Terms and Conditions of Sale and must comply with them.

III. RIGHTS AND OBLIGATIONS OF THE SELLER

  1. The SELLER undertakes to provide all the conditions for the BUYER to use the services provided by the e-shop.
  2. If false, inaccurate or misleading data are provided during registration or subsequently, or if the BUYER does not comply with other obligations provided for in these Terms and Conditions, the SELLER shall have the right to immediately cancel the registration and delete the BUYER’s data, or to limit the BUYER’s right to use the services of the e-store.
  3. The SELLER reserves the right, without prior notice, to suspend or terminate the BUYER’s registration and use of the e-shop if there is reason to believe that the BUYER is engaging in unauthorised activities or otherwise attempting to undermine the operation or stable functioning of the e-shop.
  4. The SELLER shall have the right to cancel the BUYER’s order without prior notice if the BUYER fails to pay for the goods within 3 (three) working days, except for payment in cash.
  5. The SELLER shall have the right to terminate the contract of sale and purchase by informing the BUYER in advance or may offer an analogous product in the event of unforeseen circumstances, if the SELLER is unable to deliver the goods ordered by the BUYER. If the BUYER refuses to accept a counterpart, refund the money paid to the BUYER within 72 hours, if prepayment was made.
  6. The SELLER shall not be liable for the actions of third parties after the use of the BUYER’s login data prior to the moment of notification. In this case, the SELLER shall be entitled to consider that the actions in the e-shop have been performed by the BUYER.
  7. The SELLER shall not be liable for the actions of third parties when using the BUYER’s e-banking system to enter into purchase and sale contracts using the e-shop services.
  1. PAYMENT FOR GOODS
  1. The BUYER can pay for the goods: using the bank’s online banking systems, cards.
  1. DELIVERY OF GOODS
  1. Goods shall be delivered by an authorised representative of the SELLER.
  2. Goods shall be delivered to the address specified by the Buyer:
    2.1. within 1 – 10 (one – ten) working days after receipt of payment for the goods, if the BUYER uses online banking systems.
    2.2 within 5-14 (five to fourteen) working days after receipt of payment for the goods, if the BUYER uses online banking systems, for advance orders.
  3. The BUYER’s signature on the consignment note shall be deemed to indicate that the consignment has been duly handed over (delivered).
  4. The BUYER must inspect the goods and the condition of the consignment at the time of delivery.
  5. If the BUYER notices any damage to the consignment, the BUYER must note it on the consignment note and draw up a free-form consignment damage report. If the BUYER signs the consignment note without remarks, the consignment shall be deemed to have been delivered in good order.
  6. Shipping costs are not included in the price of the item in the e-shop.
  7. The Seller shall not be liable for any breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties not related to the Seller or due to circumstances beyond the Buyer’s control.
  8. If the Buyer fails to collect the parcel from the post office within the specified time limit, the parcel shall be returned to the Seller. The Customer shall be liable to reimburse the Seller for all direct losses incurred by the Seller in connection with the delivery and return of the consignment to the Seller, upon the Seller’s written request. Failure to collect the shipment without prior written, e-mail or telephone notification to the Seller shall be considered as abuse and the Seller may claim the cost of transportation. The buyer loses the option to pay in cash and will have to pay all future orders in advance by bank transfer. If the parcel is not collected, the buyer must pay the shipping costs, even if free delivery was applied. Shipping costs are calculated both ways: 2x Omniva (price 8.24€ for Estonia; Latvia 5.48€;Lithuania 2.75) post offices. An administration fee of €2 applies.
  1. RETURN OF GOODS
  1. The characteristics of each item sold by glajakids.lt are generally indicated in the description of each item. The SELLER shall not be liable for the fact that the colour, shape or other parameters of the goods in the e-shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the display used by the Buyer.
  2. The defects of the sold goods shall be eliminated, defective goods shall be replaced and returned in accordance with the Civil Code of the Republic of Lithuania and the Retail Trade Rules approved by the Government of the Republic of Lithuania in 2014. 22 July Resolution No 738.
  3. In order to return the product(s) , the BUYER must complete the return document that accompanies the goods ordered by the BUYER and submit it together with the returned product(s).
  4. The following conditions must be observed when returning goods to the buyer:
    4.1. the returned product must be in the original packaging in good condition in which it came;
    4.2. the goods must be in good condition;
    4.3. the product must be unused and in good condition (intact, with labels, protective films, etc.);
    4.4. the returned goods must be in the same condition as when received by the BUYER;
    4.5 When returning an item, you must provide proof of purchase;
    4.6. The SELLER shall have the right not to accept the goods returned by the BUYER if the BUYER does not comply with the return procedure set out in this Article.
  5. In the event that the goods purchased by the BUYER are defective in quality, the BUYER’s claims against the SELLER for defects in quality may be made within 1 month. the warranty period, i.e. the BUYER shall, within 1 month,. the warranty period, shall be entitled, at his option, to claim from the SELLER:
    5.1 remedy the defects in the item free of charge (repair the item);
    5.2 replace the faulty item with an item of suitable quality free of charge;
    5.3 reduce the price of the product;
    5.4 unilaterally terminate the contract and demand reimbursement of the price paid for the goods (in accordance with Article 6.363(7) of the Civil Code).
  6. Upon return of the goods, the money shall be transferred to the bank account specified by the BUYER within 14 days from the date of acceptance of the returned goods (this point does not apply in the case of low-quality goods, in which case the return of the goods shall be carried out within the statutory warranty period).

VII. FINAL PROVISIONS

  1. These Rules shall be governed by the law of the Republic of Lithuania.
  2. Any disagreement regarding the application of these Rules shall be settled by negotiation. In the event of disagreement, disagreements shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
  3. The SELLER, taking into account the changes in the market and the applicable legislation, shall have the right to amend or modify these Terms and Conditions and other documents related to the Terms and Conditions, informing the BUYER thereof on the e-shop website. Additions or changes to the Rules shall take effect from the time of publication for all transactions entered into after publication, and it is therefore recommended that the BUYER familiarises himself with the Rules at the time of each shopping trip. If the BUYER does not agree with the new wording of the Terms and Conditions, amendments, modifications, he/she has the right to refuse them, provided that the BUYER loses the right to use the e-shop services.
  4. If the BUYER continues to use the services provided by the e-shop after the amendment of the Rules, the BUYER shall be deemed to accept the new wording of the Rules, amendments or additions.
  5. The Agreement shall remain in force until the parties have fulfilled all their obligations under it.
  6.
